Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving reasons.
The withdrawal period is 14 days from the day,
- on which you or a third party named by you, who is not the carrier, have or has taken possession of the goods, provided that you have ordered one or more goods as part of a single order and these are delivered uniformly;
- on which you or a third party named by you, who is not the carrier, have or has taken possession of the last goods, provided that you have ordered several goods as part of a single order and these are delivered separately;
To exercise your right of withdrawal, you must inform us (Svetozar Grbic, Von-Werthern-Str. 4a, 96487 Dörfles-Esbach, Phone no.: +49 89 215 400 980, E-mail address: de.info@gripmaxx.de) by means of a clear declaration (e.g. a letter sent by post or an e-mail) of your decision to withdraw from this contract. You can use the attached sample withdrawal form for this purpose, which is not mandatory. You can also exercise your right of withdrawal online under a correspondingly designated button ("Withdraw contract" or similar designation) on our website (donnerberg.net). If you use this online function, we will immediately send you a confirmation of receipt on a durable medium (e.g. by e-mail) with information on the content of the withdrawal declaration as well as the date and time of its receipt.
You can also fill out and submit the sample withdrawal form or another clear declaration electronically on our website (donnerberg.net). If you make use of this option, we will immediately send you (e.g. by e-mail) a confirmation of receipt of such a withdrawal. To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
Consequences of withdrawal
If you withdraw from this contract, we must refund all payments we have received from you, including delivery costs (with the exception of the additional costs resulting from your choosing a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within 14 days from the day on which we received the notification of your withdrawal from this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged fees for this refund.
We may refuse the refund for goods that can be sent by parcel post until we have received these goods back or until you have provided proof that you have sent these goods back, whichever is the earlier date.
We will collect the goods that cannot be sent by parcel post.
You must return or hand over the goods that can be sent by parcel post to us without undue delay and in any case no later than 14 days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods that can be sent by parcel post before the expiry of the 14-day period.
We bear the costs of returning parcel-postable goods. You bear the direct costs of returning non-parcel-postable goods in the amount of EUR 500.
You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary to check their condition, properties and functionality.
Exclusion or expiry reasons
The right of withdrawal does not apply to contracts
- for the supply of goods that are not prefabricated and for the manufacture of which an individual choice or determination by the consumer is decisive or that are clearly tailored to the personal needs of the consumer;
- for the supply of goods that can spoil quickly or whose expiration date would be quickly exceeded;
- for the supply of alcoholic beverages whose price was agreed upon conclusion of the contract, but which can be delivered at the earliest 30 days after conclusion of the contract and whose current value depends on fluctuations in the market over which the entrepreneur has no influence;
- for the supply of newspapers, periodicals or magazines with the exception of subscription contracts.
The right of withdrawal expires prematurely for contracts
- for the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene if their sealing was removed after delivery;
- for the supply of goods if, after delivery, they were inseparably mixed with other goods due to their nature;
- for the supply of sound or video recordings or computer software in a sealed package, if the sealing was removed after delivery.
